Derk graduated in tax and private law from the University of Leiden. He started his career as an attorney-at-law in the tax department of a large Netherlands law firm. In 2002 Derk moved to Luxembourg to set up an office for that law firm there. He was made partner in that same year. In February 2006 Derk switched to VMW Taxand. Derk specialises in corporate and international taxation. His work mostly involves advising on the Netherlands corporate and international aspects of private equity and real property investments, project finance, group tax planning, licensing, mergers, acquisitions, reorganisations, debt restructuring, joint ventures, and employee benefits. He also litigates, however, in tax matters as well as private law matters with a fiscal perspective.

Derk’s major assignments in the recent past are advising an institutional investor on the acquisition of a very large portfolio of commercial real property in the Netherlands, structuring the lease of flight simulators by a financier to various international airlines, advising a major French bank on the acquisition of a Netherlands private bank and conducting a Fin 48 review for a major US provider of power generation equipment and maintenance services for customers in the power infrastructure and services industries.

Derk has authored many articles on Netherlands and international taxation in domestic and international periodicals on taxation. He has written extensive comments on thin capitalisation, hybrid loans, non-deductible expenses and incentives for shipowners for one of the two leading handbooks on Netherlands taxation. Derk is a member of the Netherlands Bar Association (NOVA), the Netherlands Association of Tax Professionals (NOB) and the International Fiscal Association.
